OVERVIEW

This website and online store are operated by Demir Cultural Concept LLC under the retail name Plumeria Orlando. Throughout these Terms of Service, the terms “we,” “us,” and “our” refer to Demir Cultural Concept LLC and Plumeria Orlando.

These Terms of Service govern your access to and use of our website, showroom services, online store, products, content, features, and related services collectively referred to as the “Services.”

By visiting our website, purchasing a product, submitting an order, or otherwise using the Services, you agree to these Terms of Service and to the policies referenced herein. If you do not agree, you should not use the Services.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer products and services to you.

  1. ELIGIBILITY AND ONLINE STORE USE

By using the Services, you represent that you are at least the age of majority in your state or place of residence or that you have given permission for a minor dependent to use the Services under your supervision.

You may not use our products, website, or Services for any unlawful, fraudulent, unauthorized, or prohibited purpose. You may not transmit viruses, malicious code, or other material intended to damage or interfere with the Services.

We reserve the right to refuse or restrict service to any person, order, or location when permitted by law.

  1. PRODUCT INFORMATION

We make reasonable efforts to display product descriptions, measurements, colors, textures, materials, photographs, availability, and prices accurately. However, display settings, lighting, photography, and the handmade nature of our products may cause the appearance of an item to differ from its online representation.

Many of our products are handmade or constructed from natural materials. Variations in grain, color, texture, shape, pattern, dimensions, and finish are expected and contribute to the unique nature of each piece. These variations are not considered defects.

Measurements are approximate. Customers are responsible for confirming product dimensions and ensuring that items will fit through doorways, hallways, stairways, elevators, and other access points before ordering.

We may modify product descriptions, specifications, prices, availability, or other information at any time without prior notice.

  1. PRICING AND PAYMENT

All prices are listed in United States dollars unless otherwise stated. Prices, promotions, discounts, taxes, shipping charges, and service fees are subject to change.

Applicable sales tax, shipping, delivery, assembly, installation, storage, and other charges may be added during checkout or communicated separately when a custom quote is required.

Payment must be made using an accepted payment method. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to process the applicable charges.

If a pricing, description, availability, or calculation error occurs, we may correct the error and contact you for instructions before fulfilling the order. If payment has already been collected and the order cannot be fulfilled, we will provide an appropriate refund or other remedy.

  1. ORDERS AND ORDER ACCEPTANCE

Submitting an order does not guarantee acceptance. We may accept, decline, limit, or cancel an order for reasons including product unavailability, pricing or description errors, suspected fraud, payment issues, delivery restrictions, or inability to fulfill the order.

An order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance. Acceptance occurs when we confirm fulfillment, prepare the item for pickup, arrange delivery, ship the item, or otherwise communicate acceptance.

Customers are responsible for providing complete and accurate billing, shipping, delivery, and contact information. We are not responsible for delays or additional charges caused by incorrect or incomplete information.

  1. CUSTOM AND SPECIAL ORDERS

Custom, personalized, made-to-order, backordered, and special-order products may require deposits, advance payment, longer lead times, and separate written terms.

Estimated production and delivery dates are not guaranteed and may be affected by manufacturing, material availability, freight, customs, weather, carrier delays, and other circumstances beyond our reasonable control.

Once production, sourcing, customization, or supplier processing has begun, custom and special orders cannot be canceled, returned, or exchanged. Deposits and payments for these orders are non-refundable except where otherwise required by law.

  1. SHIPPING, DELIVERY, AND PICKUP

Shipping, local delivery, nationwide freight, and in-store pickup are governed by our Shipping & Delivery Policy, available at:

Delivery availability, cost, and timing depend on the product, destination, access requirements, and delivery method. Delivery estimates are estimates only unless expressly guaranteed in writing.

Customers must inspect products promptly upon pickup or delivery and report shipping damage, missing items, defects, or incorrect items according to our published policy.

Risk of loss may transfer to the customer upon delivery, pickup, or transfer to the applicable carrier, subject to applicable law and any written delivery agreement.

  1. RETURNS, EXCHANGES, AND CANCELLATIONS

Returns, exchanges, damaged items, final-sale products, and order cancellations are governed by our Return & Exchange Policy, available at:

All sales are final, and refunds are not offered except when required by applicable law or expressly stated in our published policy.

Eligible unused items may be exchanged only after receiving prior approval and satisfying all conditions in the Return & Exchange Policy.

  1. INTERIOR DESIGN AND OTHER SERVICES

Any interior design, consultation, customization, installation, project management, sourcing, or related professional service may be subject to a separate proposal, scope of work, estimate, agreement, payment schedule, or cancellation policy.

Product purchases do not automatically include design, delivery, assembly, installation, styling, or project-management services unless expressly stated in writing.

Renderings, mood boards, suggestions, measurements, and design concepts are provided for the specific project and purpose described in the applicable written agreement.

  1. ACCURACY OF INFORMATION

Information on the website is provided for general informational and shopping purposes. Although we strive for accuracy, some information may be incomplete, outdated, or inaccurate.

We reserve the right to correct errors, inaccuracies, or omissions and to update information or cancel affected orders when permitted by law.

  1. THIRD-PARTY SERVICES AND LINKS

The Services may include tools, payment services, applications, content, or links provided by third parties, including Shopify and payment, delivery, social-media, and technology providers.

We do not control third-party websites or services and are not responsible for their availability, content, privacy practices, security, or performance. Your use of third-party services may be subject to separate terms and policies.

  1. INTELLECTUAL PROPERTY

All website content, including photographs, graphics, text, product descriptions, designs, logos, branding, videos, layouts, and other materials, is owned by or licensed to us and is protected by applicable intellectual-property laws.

You may use the website only for personal, non-commercial shopping and informational purposes. You may not copy, reproduce, modify, publish, distribute, sell, license, scrape, or commercially exploit any content without prior written authorization from the applicable rights holder.

  1. CUSTOMER CONTENT AND FEEDBACK

If you submit reviews, photographs, comments, suggestions, testimonials, or other content, you represent that you have the right to provide it and that it does not violate another person’s rights or applicable law.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, display, and publish voluntarily submitted reviews, feedback, or promotional content in connection with our business, subject to applicable privacy law.

We may remove content that we reasonably believe is unlawful, misleading, abusive, infringing, or otherwise inappropriate.

Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Demir Cultural Concept LLC, Plumeria Orlando, and their owners, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from or related to use of the Services or purchase of products.

Where liability cannot be excluded, our total liability will be limited to the amount paid for the product or service giving rise to the claim, except where a different remedy is required by applicable law.

These limitations do not apply to liability that cannot legally be limited or excluded.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Demir Cultural Concept LLC, Plumeria Orlando, and their owners, employees, agents, contractors, and service providers from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another person’s rights.

  1. FORCE MAJEURE

We are not responsible for delays or failure to perform caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fire, labor disruptions, transportation delays, supplier or manufacturing delays, carrier interruptions, government action, customs delays, power or internet outages, or similar events.

We will make reasonable efforts to communicate material delays and provide an appropriate resolution where required.

  1. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

  1. WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any provision does not constitute a waiver of that provision.

These Terms, together with our posted policies and any applicable written order, proposal, or service agreement, constitute the agreement governing your use of the Services. If a separate signed agreement conflicts with these Terms, the signed agreement controls for the specific transaction covered by it.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles.

Any legal proceeding relating to these Terms or the Services must be brought in a court with appropriate jurisdiction in Orange County, Florida, unless applicable law requires otherwise.

  1. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes in our operations, Services, policies, or legal obligations. Updated Terms will be posted on this website with a revised “Last Updated” date.

Your continued use of the Services after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.
